What is the difference between the Maharashtra and Karnataka formats?
Maharashtra uses the "Leave & License" format governed by the Maharashtra Rent Control Act 1999 — the language grants a "license to occupy" rather than a tenancy right. Karnataka uses a standard "rental agreement" format under the Karnataka Rent Act. The legal implications differ: Maharashtra's L&L format gives landlords stronger possession rights.
Can I modify the template clauses?
Yes, but carefully. You can modify clauses like rent amount, deposit, notice period, and add custom conditions (parking, pet policy, etc.). Do not remove the mandatory legal clauses (parties, property description, term, rent, deposit, termination conditions) as these are essential for the agreement to be enforceable.
When do I need a Power of Attorney for a rent agreement?
You need a POA when the landlord cannot be physically present to sign — for example, NRI landlords, or owners living in another city. The POA authorizes a local representative (family member, friend, or agent) to sign the agreement on the landlord's behalf. The POA itself must be notarized (or registered, for extra safety). NRIs executing a POA abroad must get it attested at the Indian Consulate/Embassy.
What is the police intimation format and who needs it?
Police intimation (tenant verification / Form C) is mandatory for all landlords in Maharashtra. It must be submitted to the local police station within 24 hours of the tenant taking possession. It includes the tenant's name, Aadhaar number, photo, address of origin, and a copy of the rent agreement. Failure to submit can result in fines for the landlord.
