Overview

What is the Standard Rental Agreement Format for Mumbai?

In Mumbai, what most people call a "rental agreement" is technically a Leave and License Agreement under Section 24 of the Maharashtra Rent Control Act, 1999. Mumbai (and the entire state of Maharashtra) does not use a traditional lease deed for residential tenancies — the Leave & License format protects landlords from the rent-control protections that historically made it difficult to evict tenants in Mumbai.

The standard format runs for 11 months, is executed on Maharashtra e-stamp paper, and must be compulsorily registered with the Inspector General of Registration (IGR) Maharashtra. Biometric verification of both Licensor (landlord) and Licensee (tenant) is conducted either at the property (doorstep biometric) or at a CSC / authorised centre.

A correctly drafted Mumbai Leave & License format will be 5–7 pages long with at least 12 clauses — Parties, Premises, Licence Fee, Deposit, Term, Lock-in, Termination, Maintenance, Society NOC, Inventory, Indemnity and Jurisdiction. Skipping the society NOC or inventory clause is a leading cause of deposit disputes in Andheri, Powai and Borivali societies.

Maharashtra Stamp Duty, Registration & Police Intimation

Stamp Duty, IGR Registration & Police Verification

Mumbai rental agreements involve three statutory steps — stamp duty under the Maharashtra Stamp Act, IGR registration under the Maharashtra Rent Control Act, and tenant verification under the Mumbai Police rules. Skipping any one of these makes the agreement legally weak.

ItemRuleExample (₹35,000 rent / ₹1L deposit · 11 months)
Stamp duty0.25% of (avg annual rent × years + non-refundable deposit + 10% of refundable deposit)(₹4,20,000 × 1) + ₹10,000 = ₹4,30,000 → 0.25% = ₹1,075
Registration fee₹1,000 (Mumbai urban) · ₹500 (rural)₹1,000
RegistrationCompulsory for every Leave & License, regardless of durationOnline via IGR Maharashtra portal
BiometricMandatory for both parties + 2 witnessesDoorstep biometric or CSC centre
Police intimationMandatory within 24 hours of move-inMumbai Police tenant verification portal / Form C
Penalty for non-registrationUp to ₹5,000 fine + 3 months imprisonmentSection 55(2), MRCA 1999

Why Mumbai stamp duty has no cap: Unlike Karnataka's ₹500 cap, Maharashtra calculates stamp duty as a strict 0.25% of the rent + deposit total. On a ₹2 lakh per month Bandra apartment, stamp duty alone can run ₹6,000–₹10,000. Use the stamp duty calculator to estimate yours.

What happens if I don't register?

An unregistered Leave & License in Mumbai is not admissible as evidence in court — meaning if your tenant defaults on rent or refuses to vacate, you cannot sue them on the strength of the agreement. The landlord also exposes themselves to a fine of up to ₹5,000 and imprisonment of up to 3 months under Section 55(2) of the MRCA. Banks, employers and the passport office also reject unregistered agreements as address proof.

Mandatory Clauses

12 Clauses Every Mumbai Leave & License Must Include

The IGR Maharashtra portal will refuse to register a Leave & License agreement that omits the core clauses below. Even when it is technically registered, missing clauses are the most common cause of deposit disputes in Mumbai's resale-heavy rental market.

Why a complete format protects you in Mumbai

For landlords

A complete L&L lets you evict a defaulting Licensee through the Small Causes Court within months — without it, eviction can drag for years.

For tenants

Locks in your licence fee for 11 months, protects against arbitrary eviction, enforces society common-area access and parking rights.

For HR & payroll

All Mumbai employers (banks, IT, corporate) require a registered Leave & License for HRA tax exemption — a notarised-only document is rejected.

For passport & KYC

RPO Mumbai and all major banks accept only a registered Leave & License as address proof. The IGR receipt is the proof of registration.

FAQ — Rental Agreement Format Mumbai
What is the standard rental agreement format for Mumbai?
A Leave & License Agreement under Section 24 of the Maharashtra Rent Control Act 1999 — executed on Maharashtra e-stamp paper, registered with IGR Maharashtra, and biometrically verified by both parties. Typical term is 11 months.
What is the stamp duty on a Mumbai rental agreement?
0.25% of (average annual rent × number of years + non-refundable deposit + 10% of the refundable deposit) under Article 36A of the Maharashtra Stamp Act. There is no upper cap — high-rent properties attract proportionally higher stamp duty. Registration fee is ₹1,000 (urban).
Is registration mandatory in Mumbai?
Yes. Section 55 of the Maharashtra Rent Control Act 1999 makes registration of every Leave & License mandatory, regardless of duration. Non-registration attracts a fine of up to ₹5,000 and imprisonment of up to 3 months.
Is police intimation mandatory for tenants in Mumbai?
Yes. Mumbai Police require landlords to submit tenant verification within 24 hours of the tenant taking possession, via Form C or the Mumbai Police online portal. AgreementDesk includes the filled tenant verification format with every Mumbai agreement.
Can I download the Mumbai rental agreement format free?
Yes — AgreementDesk offers a free DOCX Leave & License template for Mumbai. But the template alone is not legally valid: it must be printed on e-stamp paper, registered with IGR and biometrically verified.
How is the Mumbai format different from Bangalore?
Mumbai requires compulsory IGR registration + biometric verification — Bangalore only requires e-stamp + optional notary. Maharashtra stamp duty is 0.25% (no cap); Karnataka is 0.5% capped at ₹500. Mumbai is therefore more expensive and slower but produces a fully court-admissible registered document.
How much security deposit is normal in Mumbai?
2 to 6 months of rent. Premium areas (Bandra, Worli, BKC) typically take 3–6 months; suburban areas (Andheri, Malad, Borivali, Mira Road) take 2–3 months. Significantly lower than Bangalore's 10-month norm.
Can I use the same Mumbai format for a commercial shop or office?
No — commercial premises use a separate Lease Deed format with different stamp duty under Article 36 (not 36A) of the Maharashtra Stamp Act, GST applicability on rent, and additional clauses for permitted use, signage, fit-out and statutory licences. Write to support@agreementdesk.in for a commercial Mumbai lease.
